HR outlook: expanding rights and protections for employees in 2024

- Leave laws: Employers should expect a marked increase in legislation creating new mandates or revising existing laws related to paid family and medical leave (PFML) and accrued paid time off or accrued paid sick and safe leave. We’ll also look at current legislative trends concerning leave/paid leave laws include securing paid leave for family bereavement, miscarriage or other pregnancy loss, and organ donation.
- Employment contracts: 2023 saw a flurry of activity aimed at banning or limiting the use of employee non-competition, non-solicitation, and nondisclosure agreements and the same is expected for 2024.
- Federal agency action: Over the last 12 months, the Equal Employment Opportunity Commission (EEOC) finally received its full slate of commissioners. In addition, the EEOC now has a confirmed general counsel for the first time since 2021. Employers can expect the agency to continue with President Joe Biden’s delayed plans, possibly due to it being an election year. The United States Department of Labor (DOL) has released a new rule for independent contractors. A final rule on salary threshold is expected by April 2024.
