HR mid-year update: changes and trends in employment laws

  • Pregnant Workers Fairness Act (PWFA): This federal law went into effect June 27, 2023. We’ll discuss how it enhances existing protections for pregnant employees and what it means for employers in states with similar laws already in place.
  • Supreme Court decisions: In late June, the Court released two decisions employers should know about. One decision ended affirmative action at universities and the other expanded employer obligations for religious accommodations under Title VII of the Civil Rights Act of 1964.
  • Pay transparency: Illinois just joined the growing number of states paying pay range disclosure laws. We’ll look at what other states could expect based on what these laws generally require.
  • Banning of non-compete contracts: Both the Federal Trade Commission and the National Labor Relations Board have indicated they don’t support non-compete agreements in employment.
  • Form I-9: Are major changes coming this year? We’ll review the possibility of a streamlined form with updated processes as well as permanent remote verification.
